INFORMATION REGARDING A SEX ESTABLISHMENT LICENCE
Sex Establishments require a licence under the Local Government (Miscellaneous Provisions) Act 1982.
A sex establishment can either be a Sex Shop or a Sex Cinema:
- A sex shop means any premises, vehicle, vessel or stall used for business which consists to a significant degree of selling, hiring, exchanging, lending, displaying or demonstrating sexual aids.
- A Sex Cinema is any premise used to a significant degree for the showing of films, which are primarily with, or related to, or are intended to stimulate sexual activity.
Legislation defines the way in which a licence application is made, which includes statutory advertising in the form of a public notice in the local press and displaying a notice outside the proposed premises for a specific period of time. This enables the general public an opportunity to lodge any comments or objections regarding the application with the Council.
When considering an application for a sex establishment licence the Council may take into account the following:
- The suitability of the applicant.
- The location and situation of the premises.
Consultation also takes place with the following:
- Lincolnshire Police.
- Parish or Town Council.
- Environmental Services.
- Planning Department.
- District Ward Councillor(s)
If an objection to the application is received then the Council's Licensing Committee, to which both the applicant and any objectors are invited to state their case, determines the application.
In most cases the applicant has the right of appeal to the Magistrates Court.
