Land Charges
 

As from the 1 April 2008, a full search will cost £90.00 and Part II optional enquiries will cost £12.00 (apart from Part II optional enquiry 22 which will cost £14.00). Any additional questions made up by yourselves will be £13.00 each. Any additional parcels of land without a common boundary will be £13.00 each. An LLC1 search will cost £20.00.

If you are a potential buyer of a property in East Lindsey, as part of the conveyancing process, a search against that property would have to be conducted to uncover any restrictions or legal obligations on the building(s) or plot of land.

A search is conducted against the "Register of Local Land Charges". This is held and maintained by East Lindsey District Council. Searches can be requested directly by you, or more usually, through your solicitors.

The Register contains details of all local land charges registered against properties in East Lindsey. Charges may relate to matters such as Tree Preservation Orders, planning decisions, grants and listed building.

You may undertake a Personal Search of the Land Charges Register (LLC1) by visiting the Council Offices, and paying a fee of £11.00. You may inspect the register by appointment only. However, if a full search is required, the Form LLC1 and Form CON29 Enquiries of Local Authorities should be sent in with the appropriate fee. Both the CON29 and LLC1 should be submitted together. Please note that searches must include the following:-

  • the correct fee;
  • a correct and clear address of the land/ property to be searched;
  • three plans with the area to be searched edged clearly in red. We cannot accept searches without a plan

Local Search applications are normally submitted by a solicitor some of whom use the National Land Information Service NLIS. This service enables electronic transmission of searches between local authorities and solicitors and payments are made through BACS. The savings in time and efficiencies made have resulted in East Lindsey being able to set a reduced fee for applications received through NLIS. Searches on properties for a prospective buyer are a statutory duty. There is a national service standard that "a land charges enquiry should be processed within 10 working days."
